How to Get a Marriage License in Palm Bay

Both people must go to the clerk's office at the same time. Bring a valid photo ID such as a state-issued driver's license, passport, or military ID. You need your Social Security number, though the card itself is not required. Under Florida Statute 741.04, both applicants must be at least 18 years old.

If either person was married before, bring the exact date the last marriage ended. Know whether it was a divorce, death, or annulment. The Florida Court Clerks & Comptrollers website lists all the requirements that apply statewide. Read the Family Law Handbook from the Florida Bar before your visit. The clerk will ask about it.

No blood test is needed. There is no residency requirement. Anyone can apply in Brevard County, even if they live outside the county or outside Florida. The difference is that Florida residents face a three-day waiting period, while out-of-state couples do not.

Palm Bay Marriage License Fees

The standard fee is $86 at the Brevard County Clerk. Both people can take a four-hour premarital preparation course to drop the fee to $61. Under Florida Statute 741.0305, this $25 discount applies when you bring the original certificates of completion. The course also waives the waiting period.

The Brevard Clerk also offers courthouse ceremonies for $30. Certified copies of a filed marriage license cost about $2.50 each. The clerk accepts cash and credit cards. Personal checks may not be accepted for marriage license fees at all locations, so bring cash or a card to be safe when applying in Palm Bay.

Palm Bay Marriage License Waiting Period

Florida residents must wait three days after the clerk issues the license. The license becomes valid on the fourth day. This comes from Florida Statute 741.04. There are ways to skip this wait. Taking a premarital course waives it. A hardship declaration can also waive it in some cases. If both people are non-residents, there is no wait at all.

Once the license is valid, you have 60 days to hold the ceremony. Under Florida Statute 741.041, the license expires after 60 days and you have to start over. After the wedding, the officiant sends the signed license back to the Brevard County Clerk within 10 days. The clerk records it and forwards a copy to the Florida Department of Health Bureau of Vital Statistics for permanent state filing. That state filing takes about 60 days.

Under Florida Statute 741.07, ordained ministers, judicial officers, clerks of the circuit court, and notaries public can all perform the ceremony. The wedding can be anywhere in Florida, not just in Palm Bay or Brevard County.

Note: If you need to search for a marriage certificate from the state, the Florida Department of Health has records from June 1927 to the present.
