How to Get a Marriage License in Volusia County

Both people must visit the Volusia County clerk's office together. Bring a valid photo ID such as a driver's license, state ID, or passport. You need your Social Security number for the form, but you do not need the card. Florida Statute 741.04 requires both applicants to be 18 years old or older. A 17-year-old may apply only with written consent from both parents, and the other person cannot be more than two years older.

If either person was married before, you need to know the exact date that marriage ended. The clerk will ask whether it was by divorce, death, or annulment. Volusia County Marriage License Fees

A marriage license costs $86 in Volusia County. Every county in Florida charges the same fee. If both people take a four-hour premarital preparation course, the fee drops to $61. That is a $25 savings allowed under Florida Statute 741.0305. Bring the original course completion certificate when you apply at the DeLand courthouse.

The $86 fee is split between the Domestic Violence Trust Fund and the State Courts Revenue Trust Fund. These splits are fixed by the Florida legislature. The Volusia County Clerk accepts various payment methods, but call ahead to confirm. Certified copies of a recorded license cost about $3 each. If you want a courthouse ceremony, the clerk may offer that for around $30. Not all Florida counties perform ceremonies, so check with the Volusia County office.

Marriage License Waiting Period in Volusia County

Florida residents must wait three days after the Volusia County Clerk issues the marriage license. The license is not valid until three full days pass. This means you cannot hold the ceremony right away unless you have taken a premarital course.

Take a four-hour premarital course from a registered provider and bring the certificate to the clerk's office. The license takes effect the same day it is issued. You also save $25 on the fee. Out-of-state residents skip the wait entirely, with or without a course.

The premarital course covers communication, conflict management, finances, and parenting. Both people can take the course together or on their own. Make sure the provider is registered with the Volusia County Clerk, or the certificate may not count.

After Your Volusia County Wedding

Under Florida Statute 741.041, a marriage license is valid for 60 days. Hold the ceremony within that time. If you do not, the license expires and you must apply again in Volusia County with a new fee. The ceremony can take place anywhere in Florida, not just in Volusia County.

After the wedding, the officiant returns the signed license to the Volusia County Clerk. The clerk records it and sends a copy to the Florida Department of Health's Bureau of Vital Statistics. State filing takes roughly 60 days. Your first certified copy is usually included with the license fee.
