Flagler County Clerk Marriage Office

How to Get a Marriage License in Flagler County

Flagler County offers an online application that you can fill out before your visit. This saves time at the office. You still have to come in person since both applicants must appear, but the online form means less paperwork at the counter.

Under Florida Statute 741.04, both people need to be at least 18 years old. No blood test is required in Flagler County or anywhere in Florida. You must read the Family Law Handbook before you apply. The clerk will ask if you have reviewed it during the application process.

Florida residents wait three days before the license goes into effect. If both parties complete a four-hour premarital course, the wait is waived and the license is active right away. Bring the original certificate. Out-of-state couples do not wait at all. The three-day rule only applies to Florida residents under Florida Statute 741.04.

Note: The license must be returned to the Flagler County Clerk within 10 days after the ceremony.

Flagler County Marriage License Fees

A standard marriage license in Flagler County costs $86 plus postage if you need the clerk to mail anything. With a premarital course certificate, the cost drops to $61 under Florida Statute 741.0305. The course needs to be at least four hours from an approved provider.

The clerk performs ceremonies for $30. Ceremony appointments are open from 8:30 to 11:30 a.m. and 1:30 to 3:30 p.m. There are no ceremony appointments between 11:30 a.m. and 1:30 p.m. Call the office at 386-313-4360 to schedule yours. Extra certified copies of a recorded marriage license cost $3 each. The Flagler County Clerk can also provide a commemorative certificate if you want one.

Marriage License Details for Flagler County

A Flagler County marriage license is valid for 60 days. Florida Statute 741.041 sets this rule for every county in the state. If the 60 days pass without a ceremony, the license is void and you need to start fresh. The wedding can take place anywhere in Florida. You do not have to stay in Flagler County.

Several types of people can perform the ceremony. Under Florida Statute 741.07, ordained ministers, clerks of the circuit court, deputy clerks, notaries public, and judicial officers can all solemnize a marriage. After the ceremony, the officiant sends the signed license back to the Flagler County Clerk for recording. A copy goes to the Florida Department of Health for permanent state records.
